Texas payday loan rules

Payday loans in Texas are arranged through a credit access business (CAB) under the Texas Finance Code (Ch. 393 and Ch. 342). Under Texas law:

  • A CAB arranges the loan from a third-party lender and charges its own separate fee on top of the lender’s interest.
  • Texas sets no statewide cap on the CAB fee or the APR.
  • There is no statewide dollar limit on the loan amount.
  • Terms typically run from about 7 to 180 days.
  • CABs must be licensed by the OCCC, post a fee schedule, and give you written disclosures before you sign.

Cost example

A $500 payday loan for about two weeks commonly costs $110–$125 in combined lender interest and CAB fee — an effective APR of roughly 560%–660%. These are typical market figures, not a legal maximum: because Texas does not cap the cost, your actual cost depends entirely on the CAB and lender. Payday loans are short-term, very high-cost credit and are not intended for long-term needs. Please consider lower-cost alternatives first.

Local ordinances

Some Texas cities have adopted their own payday-lending ordinances that add borrower protections beyond state law — for example, tying the loan amount to a share of your income, or limiting rollovers and installments. We do not state which local rules apply to any given borrower. Check with the City of Plano and confirm the terms with your lender before you sign.
